ENVIRONMENTAL DISPUTE NEGOTIATION AND RESOLUTION
(LAWE-4260) - 2 UNITS

This course develops skills in negotiation as they can be applied to the resolution of environmental disputes. It will help a student prepare for and carry out a negotiation, become a more effective communicator and listener, manage disparate factual and scientific information, and understand the psychological dimensions inherent in negotiation processes. In addition, the course will examine mechanisms for assisting negotiations -- facilitation and mediation. The class will be divided into: 1) pre-litigation facilitation and dispute resolution, as well as 2) negotiation and mediation of litigated cases. Negotiation skills are best developed through an iterative process that presents frameworks for negotiation analysis and allows students to exercise them. This course will employ experiential learning and simulations that allow students to work in teams, engage in controlled bargaining situations, followed by individual and team debriefings that critique strategy and style.
