CONTRACTS OF ADHESION SEMINAR

An estimated ninety-nine percent of modern agreements are not the paradigmatic bargained-for exchanges between equals that law students study in their basic contracts class. Instead, they are contracts of adhesion: non-negotiable standard forms. In this seminar, we will examine the unique theoretical and doctrinal issues raised by these agreements. These issues should be helpful for those planning to pursue a career in civil litigation, or anyone who has signed a cell phone contract, opened a credit card account, or clicked "I agree" on a software license.
