This course explores the dance between the law and sellers of consumer goods, services, and credit, against the background music of our cultural beliefs about consumers.Consumer law is an immense topic, including everything from products liability to investor protections.We will focus on:
the move from common law fraud and contract claims to statutory unfair and deceptive trade practices claims, the costs and benefits of disclosure as a form of regulation of credit card, home mortgage, and other consumer credit transactions, the tension between facilitating transactions and minimizing the risk of errors and abuses in our private credit reporting system, the successes and limits of legal prohibitions on discrimination in consumer transactions, enforcement of consumer law in the age of arbitration.
